The SARB Group manages its legal risk through the legal department by applying a centralized legal risk management framework. This framework is contained in the Legal Risk Management Policy, which is read in conjunction with the Group`s Risk Management Policy. What happens at an SARB hearing? A group of volunteers investigates the situation after listening to the student and parents explain why they are not attending school. The committee will develop a plan and the terms and supports that will be developed will be added to a legally binding contract that the student and parents will have to abide by. The SARB case manager has the authority to refer the case to the district attorney if truancy and unjustified absences continue to be an issue after the SARB hearing. A judge then orders compliance with the Attendance Act and may place a student over the age of 12 in the youth room if all efforts to support the student have failed. PARENTS: You are responsible for your child`s school attendance. You must inform the school if your child is not attending school and provide a legitimate reason for the absence. You need to make sure your child goes to school regularly and on time every day. STUDENTS: If you miss school, you will miss opportunities to learn how to become a good citizen, build lasting friendships, and develop the skills and attitudes needed to become a valued employee. School Attendance Review Board (SARB). The mission of the School Attendance Review Board (SARB) is to help students stay in school, attend school regularly, and graduate. SARB is a community-based effort to pool resources to support families with attendance and absenteeism issues. The SARB level is the district`s last chance to keep students and families out of the justice system. SARB`s intervention with each student begins after a complete reference file has been received from the respective school. A serious attendance problem often begins with a few unjustified absences. Counsellors, teachers, nurses, school police officers and an attendance review team may be called in to assist students at the school site level – the School Attendance Review Team (SART). If the school has exhausted all resources and a student`s attendance has not improved, a family may be referred to a SARB hearing. The SARB Process (Click here to view)What are the attendance laws for students? California Education Codes 48200 – Children Ages 6 to 18 Anyone between the ages of 6 and 18 who is not otherwise exempt is subject to full-time compulsory education. 48260 (a) – Definition of truancy Any student who is subject to mandatory training, full-time or continuing, who is absent from school for three full days in a school year without just excuse, or who is late or absent three times in a school year during the school day without just excuse, or a combination thereof, skipped school and must be reported to the Director of Attendance or the Superintendent of the school district. All children between the ages of 6 and 18 are required to attend school under California Education Act, and their parents are required by law to ensure their child`s presence.
The law also states that a student`s refusal to attend school regularly may result in referral to the School Attendance Review Board (SARB), juvenile probation, and the juvenile justice system. In addition, parents who do not force the presence of their child can be prosecuted and punished. What is SARB? The School Attendance Review Board deals with chronic attendance and truancy issues. SARB offers students one last chance to improve their attendance before a referral to juvenile court. When does SARB intervene? If school sites have exhausted their resources and school attendance has not improved, a family can be referred to the SARB department. The SARB office will then schedule a hearing before a committee, and the student and parents/guardians must attend. Who is on the SARB committee? At an SARB hearing, students and their parents meet with a committee that may consist of: A strong team of in-house counsel provides legal advice, negotiates and drafts contracts and legal documentation, manages litigation and disputes, and drafts and/or approves related laws, regulations and standards.
