The Court of Appeal sitting in Calabar has ordered the Independent National Electoral Commission to conduct fresh elections for the position of Senator in the next 90 days for Essien Udim local government area in Akwa Ibom state.
This comes after the court allowed the appeal filed by Senator Godswill Apkabio, representing the All Progressives Congress (APC) and challenging the winner of the February 23rd 2019 elections, Senator Christopher Ekpenyong and rejecting his victory.
The judgments were read by a three-man panel led by Justice Tank Hussein, and the Appeal Court in its ruling said that the declaration of Epkenyong as the winner was invalid, claiming that there was proof of irregularities and non-compliance with the Electoral Act in the conduct of the election.
On the same sitting of court, it also ruled on six other judgments with the All Progressives Congress succeeding in four and the People’s Democratic Party succeeding in two.
Hon. Patrick Ifon of the People’s Democratic Party also won the judgment case in Eket/Esit Eket/Ibeno/ONNA Federal Constituency against Kufre Akpabio of the All Progressives Congress, and the court upheld his victory to represent his constituency at the National Assembly.
Asides the six cases read, two other cross-appeals from the PDP against the APC in Akwa Ibom northwest were not heard because they had been filed late.
